Welcome to Pet2Cute. The terms “we,” “us” and “our” refer to Pet2Cute, a trading name of MMCH GROUP LIMITED.

Pet2Cute operates this website and online store, including the related information, content, features, tools, products and services made available to customers (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced on our website, describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not access or use the Services.

Nothing in these Terms excludes or limits any mandatory consumer right that cannot legally be excluded or limited.

SECTION 1 — ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your country, state or province of residence, or that you have obtained the consent of your parent or legal guardian.

To browse our store, create an account or purchase products, you may be required to provide information including your name, email address, billing information, payment information and shipping address.

You represent that the information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign or license your account to another person.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to display and describe our products accurately. However, colours and appearance may vary slightly depending on your screen, device settings, lighting conditions and manufacturing batch.

Product dimensions, weights and measurements are approximate unless expressly stated otherwise. Minor variations that do not materially affect a product’s function are not considered defects.

Product images may include props, accessories or animals for illustration. Only the products expressly identified in the product description are included in the purchase.

Nothing in these Terms excludes or limits any mandatory rights you may have where a product is faulty, unsafe, misdescribed or otherwise does not conform to applicable consumer law.

We may update product descriptions, discontinue products or limit the quantities available to any person, geographic region or jurisdiction. Changes will not affect an order we have already accepted unless we contact you and offer an appropriate solution.

You are responsible for selecting products that are suitable for your pet’s size, breed, age, health and behaviour. Products intended for pets should be used under appropriate supervision and in accordance with any instructions, warnings or size recommendations supplied with the product.

No pet toy or accessory is indestructible. Discontinue use immediately if a product becomes damaged or presents a risk of injury or ingestion.

SECTION 3 — ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase from Pet2Cute. An order is accepted when we send confirmation that it has been accepted or when we begin processing it for fulfillment.

We reserve the right to decline or cancel an order where reasonably necessary, including because of product unavailability, suspected fraud, payment failure, pricing or product-information errors, shipping restrictions or legal requirements.

If we decline or cancel an order after payment has been received, we will refund the amount paid for the cancelled portion.

Please review your order carefully before submitting it. We process orders promptly and cannot guarantee that an order can be changed or cancelled after it has been placed. If you need assistance, contact info@pet2cute.com as soon as possible.

Returns and refunds are governed by our Refund Policy. Nothing in these Terms or our Refund Policy limits mandatory cancellation, return, guarantee or remedy rights available under applicable consumer law.

Products purchased from Pet2Cute are intended for personal or household use and not for unauthorized commercial resale.

SECTION 4 — PRICES, PAYMENTS, TAXES AND IMPORT CHARGES

Prices, discounts and promotions may change without notice. The price applicable to an accepted order is the price displayed at checkout and confirmed in the order confirmation.

Shipping charges and any taxes collected by Pet2Cute will be displayed at checkout.

International orders may be subject to import VAT, sales tax, customs duty and carrier or customs-handling charges imposed by the destination country.

Unless these amounts are expressly identified as prepaid or included at checkout, they are the customer’s responsibility. We do not control and cannot predict charges imposed by foreign tax, customs or delivery authorities.

We are not responsible for delays or charges resulting from a customer’s refusal or failure to pay legally imposed import charges. This does not affect mandatory consumer rights.

You agree to provide current, complete and accurate payment, billing and account information. You represent that you are authorized to use the payment method submitted with your order.

If a clear pricing or product-information error affects an order, we may contact you before fulfillment and offer you the choice of proceeding with the corrected information or cancelling the affected item for a full refund.

Promotions may be subject to separate conditions. If promotional conditions conflict with these Terms regarding the specific promotion, the promotional conditions will apply.

SECTION 5 — SHIPPING AND DELIVERY

Orders are normally processed within 1–3 business days unless otherwise stated.

Standard tracked shipping is estimated to take approximately 7–14 business days after dispatch unless a different estimate is displayed at checkout.

Delivery dates are estimates and are not guaranteed. Delivery may be affected by customs clearance, destination-country procedures, peak seasons, public holidays, severe weather, remote destinations, incorrect address information and other circumstances outside our reasonable control.

We remain responsible for an order until it is delivered to you or to a person designated by you, except where applicable law provides otherwise.

If tracking indicates that a parcel may be lost, damaged in transit or delivered incorrectly, contact info@pet2cute.com so that we can investigate with the carrier.

You are responsible for providing a complete and accurate delivery address. Where permitted by law, you may be responsible for additional delivery costs resulting from an incorrect or incomplete address, an unsuccessful delivery caused by circumstances within your control, or failure to collect a parcel.

If a parcel is returned to us because delivery was refused, import charges were not paid, the address was incorrect or the parcel was not collected, we may deduct reasonable shipping, return and handling costs from any refund where permitted by law.

SECTION 6 — RETURNS, CANCELLATIONS AND REFUNDS

Except where longer statutory rights apply, customers may request a return within 14 calendar days after the last product in an order is recorded as delivered.

For voluntary or change-of-mind returns, the customer is responsible for arranging and paying the direct cost of return shipping. Customers must contact info@pet2cute.com and obtain return authorization, instructions and the correct return address before sending a product.

Pet2Cute does not charge a fixed restocking fee. Where permitted by applicable law, we may deduct an amount reflecting an actual loss in value caused by handling beyond what is reasonably necessary to establish the product’s nature, characteristics, fit and functioning.

Customers may request cancellation at any time before an order has been fulfilled or dispatched. Once an order has been fulfilled or dispatched, it will be handled under our Refund Policy and any mandatory withdrawal rights that apply.

Products that are defective, unsafe, damaged upon arrival, sent incorrectly, misdescribed or otherwise non-conforming remain subject to all mandatory consumer rights and remedies.

Personalized or made-to-order products, perishable products, and sealed products that are unsuitable for return for genuine health or hygiene reasons after being unsealed may be excluded where applicable law permits.

A discounted, sale or Final Sale designation does not exclude any mandatory consumer right.

Complete eligibility requirements, procedures, exceptions and statutory rights are stated in our Refund Policy, which forms part of these Terms.

SECTION 7 — INTELLECTUAL PROPERTY

The Services, including our trademarks, brand names, logos, text, graphics, product photographs, videos, audio, website design and arrangement of content, are owned by or licensed to MMCH GROUP LIMITED and are protected by applicable intellectual-property laws.

You may use the Services only for lawful, personal and non-commercial purposes.

Unless we provide prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, sell or commercially exploit material from the Services.

Pet2Cute’s name, logos, product names, designs and slogans are trademarks or other intellectual property belonging to MMCH GROUP LIMITED or its licensors. Shopify’s name and trademarks belong to Shopify. Other names and trademarks appearing through the Services belong to their respective owners.

No provision of these Terms grants you ownership of or a license to our intellectual property except for the limited right to access and use the Services in accordance with these Terms.

SECTION 8 — OPTIONAL TOOLS

We may provide access to tools, features or services supplied by third parties. We do not necessarily monitor or control these third-party tools.

Third-party tools are provided on an “as available” basis and may be governed by separate terms and privacy policies. You should review and understand the applicable third-party conditions before using them.

To the extent permitted by law, we are not responsible for loss arising solely from a third-party tool outside our reasonable control. Nothing in this section excludes liability that cannot lawfully be excluded.

New tools, services and website features that we introduce may also form part of the Services and will be subject to these Terms.

SECTION 9 — THIRD-PARTY LINKS

The Services may contain links to websites, content or services operated by third parties.

We are not responsible for examining or guaranteeing the accuracy, availability, safety or practices of independent third-party websites.

If you access a third-party website, you do so subject to that third party’s terms and privacy practices. Review those policies before providing information or completing a transaction.

Questions or complaints concerning products or services purchased directly from an independent third party should be directed to that third party.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Pet2Cute is powered by Shopify, which provides the ecommerce platform used to make the Services available.

Sales made through our store are transactions directly between you and MMCH GROUP LIMITED, trading as Pet2Cute. Shopify is not the seller of our products and is not responsible for fulfilling Pet2Cute orders.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for injury, damage or loss arising solely from products sold directly by Pet2Cute.

Nothing in this section limits any right you may have directly against Shopify under applicable law or under a separate service provided to you by Shopify.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify processes certain personal information relating to your access to and use of the Services. Information may also be transmitted to payment providers, delivery companies, technology providers and other service providers where necessary to process orders and operate the Services.

Some providers may process information in countries or regions other than your own. Further information about how personal information is collected, used, disclosed and protected is available in our Privacy Policy and Shopify’s applicable privacy notices.

By using the Services, you acknowledge that you have had the opportunity to review these privacy notices.

SECTION 12 — FEEDBACK AND REVIEWS

If you submit a review, photograph, suggestion, idea or other feedback to us, you grant MMCH GROUP LIMITED a worldwide, non-exclusive, royalty-free and sublicensable license to use, reproduce, adapt, publish and display that content for the purposes of operating, improving and promoting Pet2Cute and its products.

You retain ownership of your original content.

You represent that you own or have permission to submit the content, that it is accurate, that you have disclosed any compensation or incentive connected with the submission and that it does not infringe another person’s rights.

We may moderate or remove content that is unlawful, fraudulent, misleading, defamatory, abusive, obscene, infringing or otherwise inappropriate.

We are not required to keep feedback confidential, pay compensation for it or respond to it unless we have separately agreed otherwise.

SECTION 13 — ERRORS AND INACCURACIES

The Services may occasionally contain typographical errors or inaccuracies relating to product descriptions, prices, promotions, shipping charges, delivery estimates or availability.

We may correct such information at any time. If an error materially affects an order that you have already placed, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling the affected item for a full refund.

Nothing in this section permits us to change an accepted order retroactively or avoid mandatory consumer obligations.

SECTION 14 — PROHIBITED USES

You may access and use the Services only for lawful purposes.

You must not use the Services:

For an unlawful, fraudulent or malicious purpose
To violate applicable laws or another person’s rights
To infringe intellectual-property, privacy or proprietary rights
To submit false, deceptive, abusive, defamatory, threatening or obscene material
To transmit viruses, malware or other harmful code
To impersonate another person or misrepresent your identity
To collect another person’s information without authorization
To send spam, phishing messages or unauthorized solicitations
To interfere with or bypass the security, integrity or normal operation of the Services
To scrape, copy, reproduce, resell or commercially exploit the Services without authorization

We may restrict or terminate access where we reasonably believe these Terms have been materially violated.

SECTION 15 — TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access to the Services where reasonably necessary, including because of a material breach of these Terms, suspected fraud, unlawful conduct, security risk or harm to Pet2Cute, Shopify or other users.

Termination does not affect rights, obligations or liabilities that arose before termination.

Provisions that by their nature should continue after termination—including provisions relating to intellectual property, privacy, payment obligations, liability, disputes and governing law—will survive.

SECTION 16 — WARRANTIES

We provide the website and its general informational content on an “as available” basis. We do not guarantee that website access will always be uninterrupted, secure or error-free.

General information on the website is provided for informational purposes and should not replace professional veterinary, medical, safety or other specialist advice where such advice is appropriate.

Nothing in these Terms excludes or limits any warranty, guarantee, condition or consumer right that cannot legally be excluded.

Products remain subject to all mandatory rights relating to safety, conformity, acceptable or satisfactory quality, fitness for purpose and correspondence with their description.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MMCH GROUP LIMITED will not be liable for indirect or consequential loss that was not reasonably foreseeable when the applicable contract was formed.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, unsafe or defective products, wilful misconduct or breach of mandatory consumer rights.

Where liability may lawfully be limited, our aggregate liability arising from an order will not exceed the total amount paid for that order, except where applicable law requires a different remedy or amount.

You are responsible for following all product instructions, warnings and reasonable safety precautions, including selecting an appropriate product for your pet and supervising its use. This does not excuse Pet2Cute from responsibility for a defective, unsafe or misdescribed product.

SECTION 18 — INDEMNIFICATION

If you use the Services for commercial purposes, you agree to indemnify MMCH GROUP LIMITED against reasonable third-party claims directly resulting from your unlawful use of the Services, infringement of another party’s rights or material breach of these Terms.

This section does not apply to ordinary consumer use and does not require a consumer to indemnify Pet2Cute, Shopify or any other party for that party’s own acts, omissions, negligence or breach of law.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms and the policies incorporated into them constitute the agreement between you and MMCH GROUP LIMITED concerning your use of the Services and purchases from Pet2Cute.

If there is a conflict between these Terms and a mandatory provision of applicable consumer law, the mandatory legal provision will prevail.

SECTION 21 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations in connection with a sale, restructuring or transfer of all or part of our business, provided that doing so does not reduce any mandatory consumer rights or remedies.

SECTION 22 — GOVERNING LAW

These Terms and purchases from Pet2Cute are governed by the laws of the Hong Kong Special Administrative Region, without prejudice to mandatory consumer protections that apply in the country or region where you reside.

The courts of Hong Kong will have non-exclusive jurisdiction over disputes arising from these Terms or the Services.

Nothing in this section prevents a consumer from bringing proceedings in another court where that right is provided by mandatory applicable law.

SECTION 23 — CHANGES TO THESE TERMS

The current version of these Terms is available on this page.

We may update these Terms to reflect changes to our Services, operations or legal obligations. Material changes will be communicated where required by applicable law and will take effect on the date stated in the applicable notice.

Changes will not retroactively reduce rights relating to an order placed before the change took effect.

Your continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
